Terms of sale

These terms apply to contracts concluded between Print Betoon OÜ and the client for 3D-printed concrete products, prototypes, modelling, production, delivery and agreed additional work.

1. General provisions

The text on this website is general information. The binding product description, quantity, price, lead time, material, tolerances, finish, delivery and allocation of responsibilities are set out in the quotation and order confirmation.

2. Quotation and conclusion of the contract

The client sends us the dimensions, drawings or a description, and Print Betoon prepares a quotation on that basis or asks for clarification. The contract is deemed concluded when the client accepts the quotation in a format that can be reproduced in writing and fulfils the payment condition stated in the quotation.

If the dimensions, model, material, quantity, place of use or other input data change during the project, the price and lead time may change. Changes are confirmed before they are implemented.

3. Custom order, prototype and experimental product

A 3D-printed concrete product is often a custom order made to the client's dimensions or model. For a new geometry, material, process or use, the quotation may define the product as a prototype, test specimen or experimental product.

Experimental status does not mean that Print Betoon waives its obligation to perform the work properly. It means that, before ordering, the purpose of the test, known limitations, properties to be assessed, restrictions on use and which properties have not been tested or certified are set out in writing.

A layered surface, reasonable variations in shade, the natural rounding of the bead and dimensional variations within the agreed tolerance are not defects if they correspond to the approved model, sample, quotation or order confirmation.

4. Technical suitability and restrictions on use

Before the quotation, the client informs us of all known loads and conditions of use, including the outdoor environment, freezing, salts, persistent moisture, soil pressure, water retention, heat, food contact, use by children, traffic and safety in public spaces.

Safety-critical use

The product must not be used as a load-bearing, lifting, traffic safety, fire safety, drinking water, food contact or other safety-critical element unless such use, the designer's responsibility, the necessary standards and testing have been expressly agreed in the order confirmation.

Installation, drilling, cutting, overloading, unsuitable ground or other modification carried out by the client or a third party may affect the product's performance. Print Betoon is not liable for a defect to the extent that it was caused by incorrect use, incorrect input information or the work of a third party.

5. Price and payment

The price and VAT are stated in the quotation. Modelling, samples, tests, finishing, packaging, transport, lifting and installation are included in the price only if they are listed in the quotation.

The payment term and any prepayment are stated on the invoice or in the quotation. Print Betoon may make the start of production conditional on a prepayment or an approved production file.

6. Lead time, delivery and transfer of ownership

The estimated lead time is confirmed after the necessary input information, model and payment have been received. The lead time may change due to a change by the client, a need for testing, material supply difficulties, unsuitable weather, logistical obstacles or force majeure.

Delivery, unloading, transfer of risk and installation are determined in the order confirmation and in accordance with the applicable law. Ownership passes to the client once the full agreed price has been paid, unless the parties have agreed otherwise.

If the agreed product cannot be delivered, we will inform the client as soon as possible and refund the amount already paid, including delivery costs. Refunds are generally made within 1 to 2 working days; depending on the payment method, it may take up to 7 working days for the funds to arrive.

7. Withdrawal and cancellation

A consumer generally has the right to withdraw from a distance contract within 14 days. The statutory right of withdrawal does not apply, among other things, to goods made to the consumer's specifications or clearly personalised.

Custom order confirmation. If the order is a custom order, this is stated in the order confirmation, and before production begins the consumer separately confirms that they are aware of the exception to the right of withdrawal. Production will not begin without this confirmation.

If the right of withdrawal applies and the consumer exercises it, we will refund all payments received no later than 14 days after receiving the notice of withdrawal. We may withhold the refund until we have received the goods back or the consumer has provided proof of having returned the goods.

If the client wishes to cancel or change the order after work has begun, they will compensate for the work already done and reasonable costs to the extent permitted by law and the agreement.

8. Conformity with the contract and claims

On receipt of the product, the client checks the quantity, visible condition and conformity with the order confirmation. In the event of a defect, please send a description, photos, the order number and information on when the defect was discovered to info@printbetoon.com.

  1. 1

Two years. In consumer sales, Print Betoon is liable for any lack of conformity of the goods with the contract to the extent provided by law, including any lack of conformity that becomes apparent within two years of delivery of the goods. No restriction that deviates to the detriment of the consumer applies.

  2. 2

First-year presumption. Within the first year of delivery of the goods, it is presumed that the defect already existed at the time of delivery. It is the seller's obligation to rebut this presumption.

  3. 3

Notification within two months. The consumer notifies us of a lack of conformity no later than two months after becoming aware of it. Earlier notification helps to identify the cause of the defect more reliably.

  4. 4

We respond within 15 days. We respond to a complaint submitted by a consumer in writing or in a format that can be reproduced in writing within 15 days.

In the case of a justified claim, an appropriate remedy is chosen in accordance with the law, such as repair, replacement, a price reduction or withdrawal from the contract, taking into account the nature of the defect and the proportionality of the measure. We are not liable for defects arising after delivery due to incorrect use, an accident or normal wear and tear resulting from ordinary use.

9. Liability

Print Betoon is liable under the applicable law for proven damage causally linked to a breach of its obligations. For business clients, Print Betoon's total liability is limited, to the greatest extent permitted by law, to the net price of the order giving rise to the claim, unless otherwise agreed in writing.

The limitation of liability does not apply to intent or gross negligence, death, personal injury or damage to health, mandatory product liability, mandatory consumer rights or any other liability that may not be excluded or limited by law.

Print Betoon is not liable for loss of profit or other indirect damage to the extent that such limitation of liability is permitted by law. This limitation does not release Print Betoon from its obligation to disclose known material risks or to deliver expressly agreed properties.

10. Intellectual property and client files

Client material

The client confirms that they have the right to use, and to submit for production, the models, drawings, photos and other files they send. The client will compensate for any justified claim arising from the unlawful use of material they have provided.

Production know-how

Unless otherwise agreed, Print Betoon's production know-how, toolpaths, process parameters and working methods remain the property of Print Betoon. The right to use the client's source file and the final result is set out in the quotation where necessary.

11. Force majeure

A party is not liable for a breach of obligation to the extent that the breach was caused by an unforeseeable circumstance beyond that party's control. The other party is informed of the obstacle and its expected impact within a reasonable time.

12. Applicable law and disputes

The contract is governed by Estonian law. Disagreements are first sought to be resolved through negotiation. Write to us at info@printbetoon.com.

If no agreement is reached, a consumer may turn to the Consumer Disputes Committee operating at the Consumer Protection and Technical Regulatory Authority. The procedural rules and the application form are available on the TTJA website. Having a complaint reviewed by the committee is free of charge for the consumer. Other disputes are resolved in the competent Estonian court.
